Infringement of Intellectual Property Rights/ DMCA:
Kitchenstaraccessories.com values people’s intellectual property rights and strives to provide a platform that is free of material that infringes on those rights. Therefore, the (DMCA) Digital Millennium Copyright Act (17 U.S.C. 512) applies among other intellectual property laws.
Kitchenstaraccessories has put in place mechanisms to receive written notice of alleged intellectual property infringements. An explanation of the allegedly trespass copyrighted work (or other intellectual property interest); An explanation of the material you state is violet and where it can be found on the Platform; Your email address, as well as your postal address and/or phone number;
A declaration from you stating that you believe the copyright does not authorize the disputed usage
A declaration by you made under the falsehood that the details in your notice are accurate and that you are the copyright (or other intellectual property) possessor or authorized to act on the ownership (or other intellectual property) owner’s favor.
You may submit a counter-notice to Kitchenstaraccessories if you believe a notice of IPI has been faultily ordered against you, including, without limitation, under Sections 512(g) of the Digital Millennium Copyright Act. Please send your counternotification to email@example.com with the subject line “Counter-Notice of Infringement.”
(We require email notice of all counter-complaints due to the timeliness of responding to intellectual property infringement notices) which contains:
- Your signature (real or electronic).
- Identification of the item that has been removed or access to which has been restricted.
- Your full name, your email address.
- A statement that you accept the Federal District court I jurisdiction in the judicial district where your address is located if the address is in the United States.
Or (ii) if your address is outside the United States, located in the State of New York, and that you will accept service of process from the complaint who submitted the notification or their authorized representative.
Any notification or counter-notice you submit in response to the above must be true and signed under penalty of perjury.
Personal liability may result from a false notification or counter-notice. Before submitting a notice or a counter-notice, you may want to consult with legal counsel. Regardless of whether Kitchenstaraccessories.com blocks access to or removes any items as a result of the preceding, please keep in mind that we may reveal your identity and the contents of any notice of counter-notice to any third party which has accused a breach of intellectual property rights hereunder or provided us with a counter-notice.
You understand and agree that any disclosures made by us following the previous will not infringe on any of your rights, including any privacy rights you may have.
